BizFinder Ltd

1. Introduction

These Terms and Conditions constitute a legally binding agreement between BizFinder Ltd (“Service Provider”) and the Client. By engaging any services, making payment, or confirming a project, the Client is deemed to have fully accepted these terms without exception.

These terms govern all services provided, including website design, development, domain assistance, hosting setup, and maintenance services.

2. Scope of Services

BizFinder Ltd provides digital services including but not limited to website design, website development, domain configuration assistance, hosting setup, and ongoing maintenance services.

All deliverables, features, timelines, and pricing are strictly limited to what has been explicitly agreed in writing (quotation, invoice, or written confirmation).

Any work not explicitly included in the agreed scope shall be considered out of scope and may incur additional charges at the discretion of BizFinder Ltd.

3. Client Obligations

The Client agrees to provide all necessary materials required for project completion in a timely manner, including but not limited to:

BizFinder Ltd shall not be held responsible for delays, errors, or incomplete delivery resulting from missing, incorrect, or delayed client submissions.

4. Payment Terms and Non-Refund Policy

Unless otherwise agreed in writing, a deposit is required before commencement of work. Full payment must be completed prior to final delivery and website deployment.

All payments are strictly non-refundable once work has commenced, regardless of project stage, as resources, time, and planning are allocated immediately upon confirmation.

Failure to complete payment may result in suspension of work, withholding of deliverables, and termination of service without liability.

5. Delivery and Timelines

All project timelines are estimates only and are dependent on client responsiveness and timely submission of required materials.

6. Domain Registration and Ownership

BizFinder Ltd may assist in domain registration and technical configuration.

A domain name is the address used to access a website (e.g. yourbusiness.com). Domain ownership remains with the Client, provided all associated fees are fully paid.

Domains are subject to annual renewal fees. Failure to renew a domain on time may result in suspension, loss of access, or permanent loss of the domain. BizFinder Ltd bears no responsibility for such loss.

7. Hosting and Maintenance Services

All websites require ongoing maintenance to ensure security, performance, and accessibility.

BizFinder Ltd offers an annual maintenance service which may include:

Hosting refers to the infrastructure that keeps a website accessible online. Without active hosting, a website will not function.

The maintenance service is billed annually and must be renewed to maintain website functionality.

BizFinder Ltd shall not be held responsible for downtime, data loss, or service interruption resulting from non-renewal of hosting or maintenance services.

8. Service Limitations and Liability Disclaimer

To the maximum extent permitted under Mauritian law, BizFinder Ltd shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use its services.

9. Revisions and Scope Control

Each project includes a limited number of revisions as defined in the agreed package.

Any additional modifications, redesign requests, or changes outside the agreed scope shall be treated as additional work and billed separately.

10. Intellectual Property Rights

Upon full and final payment, ownership of the delivered website design is transferred to the Client.

BizFinder Ltd retains the right to use non-confidential aspects of the project for portfolio, marketing, and promotional purposes unless explicitly restricted in writing.

11. Termination

BizFinder Ltd reserves the right to terminate any project if:

In the event of termination, the Client remains liable for all work completed up to the termination date. No refunds shall be issued.

12. Confidentiality

BizFinder Ltd will exercise reasonable care to protect Client information. However, confidentiality does not extend to information required for service delivery or legal compliance.

13. Force Majeure

BizFinder Ltd shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, internet outages, government actions, or third-party service failures.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Mauritius. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius.

15. Acceptance of Terms

By engaging services, making payment, or confirming a project, the Client acknowledges that they have read, understood, and irrevocably agreed to these Terms and Conditions in full.
